Under Texas law, child trafficking is a serious criminal offense defined by the Texas Penal Code, Title 5, Section 20A.02. The statute outlines several actions that constitute human trafficking, particularly when they involve minors or disabled individuals. For a person to be convicted of human trafficking, the prosecution needs to prove that one or more of the following occurred:
Engaging in Trafficking for Forced Labor or Services: Knowingly engaging in trafficking with the intent of forcing the trafficked individual, including a child, to provide labor or services against their will.
Benefiting from Trafficking Ventures: Receiving any form of benefit from participating in or being part of a trafficking operation involving forced labor or services.
Trafficking for Sexual Exploitation: Trafficking an individual, including a child, and using force, fraud, or coercion to involve them in illegal activities such as prostitution, online promotion of prostitution, or other prohibited sexual acts.
Trafficking with Intent to Exploit a Child or Disabled Individual: Trafficking a minor or disabled person with the intent that they engage in forced labor, services, or sexually exploitative conduct, regardless of consent or perceived willingness.
Profiting from Exploitation: Gaining benefits from participating in ventures involving the sexual exploitation of children, including prostitution, pornography, or other abusive activities prohibited under state law.
For the purpose of this law, a child is anyone younger than 18. The law explicitly includes acts such as sexual abuse, aggravated assault, prostitution, and possession of child pornography under its purview when committed against trafficked children or disabled individuals. These offenses carry severe penalties to reflect the gravity of the crime.
Child trafficking is not only prosecuted under Texas state law but also under federal law, which often carries even harsher penalties. Federal child trafficking offenses are outlined in 18 U.S.C., Section 1591. This statute defines the crime as knowingly engaging in the recruitment, harboring, transportation, provision, obtaining, advertising, patronizing, or soliciting of a minor for the purpose of a commercial sex act.
Importantly, under federal law, proof of coercion, fraud, or force is not required if the victim is under 18 years old. Similar to Texas law, federal law criminalizes not only direct child trafficking actions but also activities such as facilitating, advertising, or financially benefiting from trafficking ventures involving minors. Additionally, a person can be charged with both state and federal child trafficking for the same actions.
Federal agencies such as the FBI, Department of Homeland Security, and other specialized task forces often investigate these cases, leveraging advanced technology and international partnerships to track offenders. Because of the complexity and high stakes of federal charges, securing an experienced human trafficking lawyer who understands both state and federal systems is crucial for anyone accused of such crimes.
The state of Texas imposes some of the harshest penalties in the nation for child trafficking offenses. Under Texas Penal Code Section 20A.02, child trafficking is classified as an enhanced first-degree felony, reflecting the severity of the crime. A conviction for child trafficking can result in a sentence ranging from 25 years to life in prison, depending on the circumstances of the case.
In addition to prison time, a convicted individual may face fines of up to $10,000, the maximum allowable under Texas law for felonies, and mandatory registration as a sex offender, which includes strict reporting requirements and public disclosure of the offender’s status. A conviction for child trafficking in Texas will also lead to the loss of some civil rights, including the right to vote and own firearms.
There can be additional collateral consequences such as difficulty in maintaining custody of children or visitation rights. Texas prosecutors are relentless in pursuing these cases, making it crucial to seek legal representation immediately if you are under investigation or charged with child trafficking.
